For Buyers and Lessees


  1. Our agency relationship
    1. You give us the right to assist you and you appoint us as your agent to represent you in buying/leasing a property that matches the search criteria you give us. This agreement creates a non-exclusive special agency relationship with the the broker unless otherwise agreed.
  2. Broker Responsibilities
    1. We must meet our agency responsibilities to you in a timely manner.
    2. In addition to the responsibilities described in R.A. 9646, Section 3.g.4, we must also:
      1. look for properties that match your search criteria, until you buy a property under this agreement, or this agreement ends.
      2. keep you informed during the search and any resulting transaction.
      3. tell the seller/lessor of a property you are interested in that we are your agent.
      4. take reasonable steps to find and give you information about properties and transactions you are interested in.
      5. help you prepare an offer and negotiate favorable terms and conditions with a seller/lessor.
      6. help you to comply with a contract to buy/lease the property.
      7. present all offers and counter-offers to and from you, even when the property is already the subject of an accepted offer.
      8. hold money we receive in trust, as the law requires.
  3. Buyer/Lessee Responsibilities
    1. During the agreement you must:
      1. communicate and cooperate with us.
      2. discuss with us any specific information you want about a property. This may include:
        1. information the seller/lessor does not have to disclose, or
        2. issues that may prevent you from buying/leasing a property.
      3. give us enough personal and financial information so we can assess your ability to buy/lease property that matches your search criteria.
      4. tell us about inquiries you make or receive about purchases/leases that affect this agreement.
  4. Broker Fees
    1. You will not be responsible to pay our fee. You authorize us to ask the lessor's/seller’s brokerage (or the lessor/seller, if the lessor/seller does not have a brokerage) to pay our fee.
    2. You understand and agree that we should not offer or agree to pay, to split or rebate any commission, fee or valuable consideration directly or indirectly with any person who is not a duly licensed practitioner or to cooperate, assist or endorse any transaction or engagement of our services in violation of any existing law, rule or regulation.
    3. We must not accept any other fees including finder’s fees, referral fees, bonuses or gifts directly or indirectly related to this agreement, unless we first tell you in writing everything relevant about the payment and you consent in writing to the payment.
  5. Personal and Confidential Information
    1. We are committed to protecting the privacy and confidentiality of your personal information.
    2. You give your consent to us to collect, maintain, use and disclose your personal information for this agreement and for all uses consistent with you buying/leasing, or potentially buying/leasing, property.
    3. You agree that we and other listing services may keep and give out information about any property bought through us for reporting, appraisal and statistical purposes. Any further or additional use of the information will require your consent.
    4. We will not:
      1. give our any of your confidential information without your consent, unless required by law.
      2. use confidential information received from you or that we get as a result of performing under this agreement for any other purpose than those in this agreement unless you agree in writing.
      3. give you any confidential information we have because of a past or present agency relationship with someone else.
    5. Our duty to keep your information confidential continues after this agreement ends.
  6. Early End to this Agreement
    1. Despite the end date agreed upon for this agreement, the agreement ends immediately if any of these things happen:
      1. you complete a purchase/lease of a property matching the search criteria.
      2. we and you agree in writing to an earlier end date.
      3. our licence to trade in real estate is suspended or cancelled.
      4. we are bankrupt, insolvent, or we are in receivership.
    2. If the agreement ends for any of these reasons, our rights and your rights under this agreement will not be affected.
  7. Contact Information
    1. The contact information provided must be used for all written communications between us and you. If this contact information changes, we and you must tell each other in writing within two business days of the change.
    2. You and you may communicate and deliver documents and information to each other in person, by mail, or electronically. We and you acknowledge there are risks with each of these methods.
    3. Should you have any question regarding these Terms, feel free to contact us. However, we do not guarantee that we will respond to all of the inquiries, and thus will not incur any liability.
  8. Governing Law
    1. These Terms are governed by Philippine law.
  9. Venue of suit
    1. In case of litigation or any dispute arising from these Terms, jurisdiction belongs to the proper courts of Makati City, to the exclusion of all other courts elsewhere situated.
  10. Buyer/Lessor Acknowledgement
    1. You acknowledge that:
      1. you have read this agreement.
      2. this agreement creates a special agency relationship with us
      3. you had the opportunity to get independent advice from a lawyer before confirming this agreement.
      4. this agreement accurately sets out what we and you agree to.

For Sellers or Lessors


  1. Our agency relationship
    1. You give us the right to assist you and you appoint us as your agent to represent you in selling or leasing out a property that you have provided. This agreement creates a non-exclusive special agency relationship with the broker unless otherwise agreed.
  2. Broker Responsibilities
    1. We must meet our agency responsibilities to you in a timely manner.
    2. In addition to the responsibilities described in R.A. 9646, Section 3.g.4, we must also:
      1. look for buyers/lessees that will buy/lease the property under this agreement, or this agreement ends.
      2. keep you informed during the search and any resulting transaction.
      3. tell the buyer/lessee that we are your agent.
      4. help you receive an offer and negotiate favorable terms and conditions with a buyer/lessee.
      5. help you to comply with a contract to sell/lease the property.
      6. present all offers and counter-offers to and from you, even when the property is already the subject of an accepted offer.
      7. hold money we receive in trust, as the law requires.
  3. Seller/Lessor Responsibilities
    1. During the agreement you must:
      1. communicate and cooperate with us.
      2. discuss with us any specific information you want about the buyer/lessee. This may include:
        1. information the buyer/lessee does not have to disclose, or
        2. issues that may prevent you from selling/leasing the property.
      3. give us enough personal, property information so we can assess the feasibility to sell/lease out the property.
      4. tell us about inquiries you make or receive about selling/leasing that affect this agreement.
  4. Broker Fees
    1. Typically you are responsible to pay our fee. You authorize us to compute the gross selling price of the property where needed which includes capital gains tax or creditable withholding tax and broker's professional fee for purposes of filling up the listing agreement or authority to sell document.
    2. You understand and agree that we should not offer or agree to pay, to split or rebate any commission, fee or valuable consideration directly or indirectly with any person who is not a duly licensed practitioner or to cooperate, assist or endorse any transaction or engagement of our services in violation of any existing law, rule or regulation.
    3. We must not accept any other fees including finder’s fees, referral fees, bonuses or gifts directly or indirectly related to this agreement, unless we first tell you in writing everything relevant about the payment and you consent in writing to the payment.

  7. Others
    1. A photocopy of the title, tax declaration and government ID of the owner will be submitted to the broker when requested
    2. Upon registration of a client via email, all negotiations regarding the sale or lease with the said client will be coursed through the broker.
    3. The broker shall still be credited with the sale/rental/lease of this property and therefore entitled to all the commissions and the fruits of this transaction even if the sale/rental/lease is consummated after expiration of this Authority provided the Buyer/Lessee(s) was/were formally registered by the broker to the owner within the prescribed period of validity of this authority. If the listing is a NET listing (commissions and the fruits of this transaction will be for the account of the Buyer/Lessee).
    4. The broker shall not be held liable for any claims to the property after consummation of the transaction
  8. Early End to this Agreement
    1. Despite the end date agreed upon for this agreement, the agreement ends immediately if any of these things happen:
      1. you complete a sale/lease of the property.
      2. we and you agree in writing to an earlier end date.
      3. our licence to trade in real estate is suspended or cancelled.

For Real Estate Brokers and Salespersons


You recognize that lasting excellence is achieved only through honor, integrity, and dignity. You acknowledge that you are expected to uphold and abide by laws and ethical standards as well as provide the same degree of professionalism listed below. You hereby promise to strive to uphold the items in this outline to the best of your ability.

You hereby undertake to adhere to the following

  1. To abide and uphold the Real Estate Service Act of the Philippines otherwise known as the RESA Law.
  2. To abide and uphold the Code of Ethics in Philippine Real Estate Service
  3. To communicate in a clear, explicit and timely manner and with all honesty
  4. To be proactive in managing the listing/requirement and keep you updated.
  5. To listen closely to be able to effectively elicit and pay attention to the details of your needs/requirements as well as listen to feedback so as to continuously improve.
  6. To be on time for viewings, appointments. I respect and value your time and I will make every effort to always be on time. In the event I will not be able to be on time I will give you a heads up with a new estimated time of arrival.
  7. You understand and agree that we should not offer or agree to pay, to split or rebate any commission, fee or valuable consideration directly or indirectly with any person who is not a duly licensed practitioner or to cooperate, assist or endorse any transaction or engagement of our services in violation of any existing law, rule or regulation.

For Referrers


You hereby understand and agree that:

  1. Only duly licensed practitioners are to make representations to government offices for the transfer of ownership of the property.
  2. duly licensed practitioner should not offer or agree to pay, to split or rebate any commission, fee or valuable consideration directly or indirectly with any person who is not a duly licensed practitioner or to cooperate, assist or endorse any transaction or engagement of our services in violation of any existing law, rule or regulation.

Photographer Release


I hereby consent and agree that Great Chua Ancheta (Photographer) has the right to take or use photographs and video of my property and to use these in any and all media worldwide including online, now or hereafter known, and for any purpose whatsoever.

I hereby release to the Photographer all rights to exhibit this work in print and electronic form publicly or privately and to market copies. I waive any rights, claims or interest I may have to control the use the photographs and video and agree that any uses described herein may be made without compensation or additional consideration of me.

The Photographer shall own all rights in the Work which shall accrue to the benefit of his/her successors, legal representatives and assigns.

With full knowledge of the above, I hereby release and shall hold harmless the Photographer and his/her successors, legal representatives, licensees and assigns from all claims or damages including but not limited to defamation or violation of right of privacy or publicity, resulting from or associated with the use of the Work.

I agree that the provisions contained herein shall be binding upon my successors, legal representatives and assigns

I represent that I am at least 18 years of age, have read and understand the foregoing statement, and am competent to execute this agreement.
